The following provisions shall survive any termination of these Terms of Service: No Warranty from StraightFromFrance.com, Limitation of Liability, Indemnity and General Provisions.

6) Parental Control Protections

As required by the Communications Decency Act of 1996, Straight From France hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to Content that may be harmful to minors.

7) Transfer of title and risk

The title to all food, drinks (alcoholic or not) and any items purchased from StraightFromFrance.com passes to the buyer at the moment payment is received. Thereafter, Straight From France acts only as the customer’s agent for shipping their goods.  The purchaser is responsible for the shipments of all orders he or she places with StraightFromFrance.com.

Straight From France cannot be held responsible for what may happen to purchases while in transit. If you receive merchandise that has been broken during shipping, you must contact us within 24 hours of receiving the parcel.

8) Notices

You authorize Straight From France to send notices via electronic mail if Straight From France decides, in its sole discretion, to do so. Prices and availability of products and information are subject to change without notice. We also reserve the right to correct to change or update information on StraightFromFrance.com at any time without prior notice.

9) Terms regarding Alcoholic Beverages

Straight From France does not sell alcohol to persons under the age of 21. By using this site you swear and affirm that you are over the age of 21. StraightFromFrance.com makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from StraightFromFrance.com is over the age of 21. You also agree that any alcohol purchased from StraightFromFrance.com is intended for personal consumption and not for resale. If you do not agree with these conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, StraightFromFrance.com will prosecute you fully to the extent allowable by law.

Because we do not actually produce or bottle any of the wines that we sell, and due to the fact that the character of wine changes with age, we are unable to completely guarantee the "drinkability" of every bottle we sell.  We can however guarantee that our wine has been cared for and stored properly since its acquisition.

10) General Provisions

You agree that Straight From France and its licensors may make improvements and/or changes in the Site Content and services or events described in this Site, if any, at any time without notice and without liability to you of any kind. You are responsible for compliance with applicable local laws, keeping in mind that access to StraightFromFrance.com may not be legal by certain persons or in certain countries. If any provision of these Terms of Service is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect.
